If you have questions about how your data is processed, or wish to exercise one of your rights, write to info@bender-pneumatic.de or to the address above.
Your rights
You may assert the following rights against us at any time:
- Access to the data we hold about you and how it is processed (Art. 15 GDPR)
- Rectification of inaccurate data (Art. 16 GDPR)
- Erasure of your data (Art. 17 GDPR)
- Restriction of processing, where legal obligations prevent us from erasing the data yet (Art. 18 GDPR)
- Objection to processing (Art. 21 GDPR)
- Data portability, where you have consented to the processing or entered into a contract with us (Art. 20 GDPR)
Where you have consented to processing, you may withdraw that consent at any time with effect for the future. For cookies and comparable techniques, a click on Cookie Settings in the footer of every page is enough.
You may also lodge a complaint with a supervisory authority. The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg (baden-wuerttemberg.datenschutz.de).
Visiting the website
Each time a page is called up, your browser sends technical information to our server, which is written to a log file there. This covers the IP address, the date and time of access, the address requested, the volume of data transferred, the browser used and the operating system.
We need this data so the page can be delivered, and to detect attacks and faults. The legal basis is our legitimate interest in a secure and functioning website under Art. 6(1)(f) GDPR. The data is not combined with other sources and is not evaluated in relation to your person.
Cookies and consent
This website stores information on your device, partly in the form of cookies. Necessary cookies are set without your consent because the site does not work without them. Everything else is loaded only once you have agreed. The legal basis is § 25(1) TDDDG and Art. 6(1)(a) GDPR.
To manage your decision we use the consent tool “Cookie Consent” from Elementor Ltd., 8 Sderot Yehudit, Tel Aviv 6706703, Israel. Your decision is stored on your device in a cookie named cookiez-user-consent and kept for one year, so the notice does not reappear on every visit. An adequacy decision of the European Commission applies to Israel, so no additional safeguard is required for the transfer.
Without your consent we store only what is required for operation. Besides the consent cookie mentioned above, that is two further entries:
pll_languageremembers whether you opened the German or the English version and contains only the language code. Lifetime one year.- Under the key
elementor, the page editor stores the number of your page views and sessions in your browser’s local storage. We use this so a notice window does not appear on every visit. The entry contains numbers only, no identifier, and never leaves your device.
Which cookies are set in detail, and which category they belong to, is shown at any time under Cookie Settings. You can change or fully withdraw your choice there. Cookies already set can additionally be deleted through your browser settings.
Contact form
You can send us an enquiry through the form on the contact page. We collect first name, surname, telephone number, mobile number, email address, postal address and your enquiry. Mandatory fields are marked as such; everything else is voluntary.
We use these details solely to process and answer your enquiry. The legal basis is Art. 6(1)(b) GDPR where your enquiry serves to initiate or perform a contract, otherwise our legitimate interest in answering enquiries under Art. 6(1)(f) GDPR.
Your details are sent to us by email and stored there. We delete them once the matter is closed and no statutory retention periods apply. For enquiries with a commercial background, the retention periods under commercial and tax law of six and ten years respectively apply.
Logging of sent emails
To deliver form messages reliably, we run the SureMail extension on our server. It creates a log entry for every message sent, containing sender, recipient, subject and the full message text. This lets us check whether an enquiry was actually delivered.
These logs are held solely on our server at our hosting provider and are deleted automatically after 30 days. The legal basis is our legitimate interest in verifiable delivery under Art. 6(1)(f) GDPR.
Protecting the form against automated submissions
So the contact form is not abused for advertising messages, we check every submission for signs of automated use. The form contains a field invisible to you that only programs fill in, and we measure the time between opening and submitting. We also limit submissions to five per sender per hour.
For that limit we do not store an IP address in plain text, only a non-reversible check value that expires after one hour. The legal basis is our legitimate interest in preventing abuse under Art. 6(1)(f) GDPR.
Google reCAPTCHA
In addition, the contact page uses reCAPTCHA v3 from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The service distinguishes human input from automated submissions based on usage behaviour.
reCAPTCHA is loaded only once you actually use the form, meaning you click or type into a field. No data is sent to Google when you merely open the page. Once loaded, the service transmits your IP address and details about your browser, operating system and behaviour on the page to Google. Transfer to the United States is possible; Google LLC is certified under the EU-US Data Privacy Framework.
The legal basis is our legitimate interest in keeping the form usable, under Art. 6(1)(f) GDPR. Further information is available in Google’s privacy policy.
Google Analytics
If you have consented to the “Analytics” category, we use Google Analytics 4, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Without that consent the service is not loaded and no data is transmitted.
Google Analytics helps us understand which channels visitors arrive through, which regions they come from and which pages they open. From this we work out which content we should improve.
What is recorded: the pages opened, the time and duration of the visit, the approximate origin at country and city level, the referring address and technical details about device and browser. We also measure clicks on external links, because our product catalogue is hosted with an external provider and we would otherwise not know whether it is being opened.
Google Analytics sets the cookies _ga and _ga_2M8F5DFMXY, which hold a randomly assigned identifier and remain on your device for two years. Google truncates your IP address before storing it, and no combination with other Google services takes place. The user and event data held in the property is deleted after the period configured there, at the latest after 14 months.
Transfer to the United States cannot be ruled out. Google LLC is certified under the EU-US Data Privacy Framework, so an adequacy decision of the European Commission applies. A data processing agreement under Art. 28 GDPR is in place with Google.
The legal basis is § 25(1) TDDDG and Art. 6(1)(a) GDPR. You can withdraw your consent at any time through the Cookie Settings; the cookies are then deleted. Further information is available in Google’s privacy policy.
YouTube videos
On some pages we embed videos hosted on YouTube, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
Nothing is loaded from YouTube when the page opens. At first you only see a preview image held on our own server. The connection to YouTube is established only when you click the play button. Google then learns your IP address and sets cookies, including for advertising purposes. If you are signed in to Google at the time, the request can be linked to your account.
We embed via the address youtube-nocookie.com, where Google states it collects less data initially. The legal basis for the request is your consent under § 25(1) TDDDG and Art. 6(1)(a) GDPR, which you give with the click. If you have previously consented to the “Advertising” category, videos load without this additional click.
Transfer to the United States is possible; Google LLC is certified under the EU-US Data Privacy Framework. Further information is available in Google’s privacy policy.
Product catalogue
We display our product catalogue as a flipbook from the provider Heyzine. Here too, nothing is loaded when the page opens. You see a preview image from our server and decide with a click whether the catalogue should open. Only then does the provider receive your IP address and technical details about your browser.
The legal basis is your consent under § 25(1) TDDDG and Art. 6(1)(a) GDPR, which you give with the click.
Hosting and technical service providers
This website runs at IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, Germany. The servers are located in Germany and the Netherlands. IONOS processes the data arising from operation on our behalf on the basis of an agreement under Art. 28 GDPR.
For backups and technical maintenance we also use UpdraftPlus and WP Umbrella. These services access the website’s content and database in order to create backups and monitor its technical condition. Data processing agreements are in place with them as well.
The legal basis is our legitimate interest in a secure, backed-up and maintained website under Art. 6(1)(f) GDPR.
Language selection
This website is available in German and English. Switching happens entirely on our own server, and no data is transmitted to third parties. The only thing stored is the cookie pll_language holding the code of the selected language, so that you return to the same version on your next visit. The legal basis is § 25(2) no. 2 TDDDG, because the website cannot be delivered in the language you want without this information.
No automated decision-making
We do not take decisions based solely on automated processing that produce legal effects concerning you. No profiling within the meaning of Art. 22 GDPR takes place.
Right to object under Art. 21 GDPR
Where we process data on the basis of a legitimate interest, you may object to that processing. On this website this concerns the server logs, the handling of form enquiries, the logging of sent emails, the protection of the form against abuse, and reCAPTCHA.
Your objection requires no particular form and no reasons, but it should make clear what it relates to. We will then stop the processing unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves to establish, exercise or defend legal claims.
Send your objection to info@bender-pneumatic.de or to the address above.
Changes to this notice
We update this privacy notice when the processing on this website changes. The version available here applies to your visit.
